Amtrak Eyes STB Investigation Into ‘Substandard’ Sunset Limited Service

Amtrak in December called on the Surface Transportation Board (STB) to initiate an investigation into “substandard” customer on-time performance for Sunset Limited service between Louisiana and California. Host freight railroad Union Pacific (UP)—which Amtrak said will likely be the prime focus of the investigation—asked the STB on Jan. 27 to order mediation for Amtrak, UP and the other host railroads involved “to resolve or narrow the issues in dispute.”

STB Denies Shipper Petitions on Rate Reasonableness Proceeding Rules

The Surface Transportation Board on Jan. 24 ruled to deny two petitions seeking reconsideration of a decision adopting final rules that establish a streamlined approach for pleading market dominance in rate reasonableness proceedings. STB adopted the rules more than two years ago.

STB Denies Request to ‘Stay’ Requirement That Class I’s Commit to Arbitration Program (Updated)

CSX, Norfolk Southern (NS), Union Pacific (UP) and the U.S. operating subsidiaries of CN on Dec. 29, 2022 requested that the Surface Transportation Board (STB) stay its requirement that the Class I railroads commit to a new arbitration program for small rate disputes. STB on Jan. 23, 2023 denied the request.

DOJ to STB: ‘Protect Rail Competition’ (UPDATED)

The U.S. Department of Justice’s (DOJ) Antitrust Division on Jan. 24 reaffirmed its “support for the [Surface Transportation] Board’s review process and careful scrutiny of the competitive implications of the proposed transaction” that would merge Canadian Pacific (CP) and Kansas City Southern (KCS). STB Eyes Emergency Service Order for UP (UPDATED)

The Surface Transportation Board (STB) on Dec. 30 directed Union Pacific (UP) to deliver certain unit trains of corn from origins in the Midwest to California on behalf of Foster Poultry Farms (Foster Farms) to alleviate “immediate service issues” while it further considers the chicken and feed producer’s exparte petition for an emergency service order. UPDATE: Foster Farms on Jan. 4 replied to UP’s daily service status updates, required by STB to start Dec. 31 and end Jan. 3. The updates will continue through Jan. 17, the railroad reported, to assist the Board with its determination.
