STB Rules in NTEC vs. BNSF Service Case

The Surface Transportation Board (STB) on June 23 issued a preliminary injunction requiring BNSF this year to transport 4.2 million tons of coal from Navajo Transitional Energy Company, LLC’s (NTEC) Spring Creek Mine in Big Horn County, Mont., to the Westshore Terminals export facility in British Columbia, Canada. The mine is solely served by BNSF. STB is also requiring the Class I to transport an additional one million tons this year as trainsets and crews become available. UP’s Rocker Issues State of the Railroad Report

“As we round out June and officially head into summer, I’m encouraged by the progress the team has made to provide a better customer experience for you,” Union Pacific (UP) Executive Vice President, Marketing and Sales Kenny Rocker told customers in a June 20 railroad status report. “The network continues to remain fluid as we build upon the service improvements that we’ve made over the past couple of months. Car velocity across the network has exceeded 200 miles per day for the ninth consecutive week, driving better on-time performance for you.”

DDRR Modifies Lease, Trackage Rights Agreements

Dover & Delaware River Railroad (DDRR) has filed a verified notice of exemption under 49 CFR 1150.41 to amend its existing lease with Norfolk Southern (NS) and existing trackage rights agreement with NS and New Jersey Transit that will allow continued operation over 107.9 miles of rail line in New Jersey.

Oberman: STB Remains Actively Involved in Rail Reg Mods

We hosted a June 15 call with Marty Oberman, Chairman of the Surface Transportation Board, on Thursday. We see a reciprocal switching ruling well before year-end, and a bottleneck ruling potentially in 2024. Rail service continues to be at the forefront of the STB’s agenda. The CPKC merger has increased competition through new north-south lanes, though further Class I consolidation is increasingly unlikely.

GRR Enters Asset Purchase Agreement

The Surface Transportation Board (STB) on May 25 granted Grenada Railroad LLC’s (GRR) request for a partial waiver of a 60-day advance notice requirement, allowing the short line to enter into an asset purchase agreement and operate approximately 228 miles of rail line in Mississippi on or after May 28, 2023.
