Pan Am Systems sues Maine-based newsletter
Written by William C. Vantuono, Editor-in-ChiefPan Am Systems Inc. reportedly has filed a lawsuit in U.S. District Court in Bangor, Maine, against trade publication Atlantic Northeast Rails & Ports, a twice-monthly newsletter, and its editor.
The Dover, N.H.-based company claims the publication reported false information on multiple occasions about the company and its former chief executive, David Andrew Fink, who left the company earlier this year. Both Fink and Springfield Terminal Railway Co. of North Billerica, Mass., also are named as plaintiffs.
In a reply brief filed last month, Yarmouth, Maine-based Atlantic Northeast Rails & Ports asked the court to dismiss the claims, saying Pan Am’s suite was "a constitutionally impermissible attempt to silence a journalistic voice."
The Pan Am Railways division owns rail operations including Boston and Maine Corp., Maine Central Railroad Co., Portland Terminal Co., and Springfield Terminal Railway Co. Pan An Systems seeks unspecified punitive damages.
